1. Platform Overview
Talent Tasker is an online marketplace that connects employers, businesses, startups, recruiters, and organizations ("Clients") with freelancers, contractors, consultants, remote workers, and job seekers ("Talent").
Clients can:
- Create business profiles
- Post jobs and projects
- Search and communicate with Talent
- Hire Talent
- Manage projects and engagements
- Review and rate Talent
Talent can:
- Create professional profiles
- Apply for jobs and projects
- Submit proposals
- Communicate with Clients
- Deliver services
- Receive ratings and reviews
Talent Tasker is solely a technology platform and is not a party to agreements entered into between Clients and Talent.
2. Eligibility
To use Talent Tasker, you must:
- Be at least 18 years old.
- Be legally capable of entering into binding contracts.
- Provide accurate registration information.
- Comply with applicable laws.
Talent Tasker reserves the right to refuse registration, suspend accounts, or terminate access at its sole discretion.
3. Account Registration
Users must create an account to access certain services.
You agree to:
- Provide accurate information.
- Maintain updated profile information.
- Protect account credentials.
- Accept responsibility for all activities under your account.
Users are solely responsible for maintaining account security.
Talent Tasker shall not be liable for losses arising from unauthorized account access.
4. User Profiles
Users may create professional profiles containing:
- Personal information
- Employment history
- Skills
- Certifications
- Portfolio items
- Project history
You warrant that all profile information is accurate and truthful. Talent Tasker reserves the right to remove misleading or fraudulent content.
5. Relationship Between Users
All engagements are solely between Clients and Talent. Talent Tasker is not an employer, is not a staffing agency, is not an employment agency, is not an Employer of Record (EOR), and does not supervise Talent.
Nothing in these Terms creates employment, agency, partnership, joint venture, or franchise relationship between Talent Tasker and any user.
6. Job Postings and Projects
Clients agree to:
- Post accurate job descriptions.
- Provide lawful opportunities.
- Communicate professionally.
- Pay agreed compensation.
Talent agrees to:
- Provide truthful qualifications.
- Deliver services professionally.
- Meet agreed deadlines.
- Maintain professional conduct.
Talent Tasker does not guarantee job placements, project awards, hiring outcomes, or business results.
7. Payments and Fees
Talent Tasker may charge Subscription Fees, Service Fees, Transaction Fees, Featured Listing Fees, Recruitment Fees, and Premium Membership Fees. Fees may change at any time with notice.
Payments may be processed through third-party providers. Talent Tasker is not responsible for payment gateway failures, banking delays, currency conversion fees, or third-party payment disputes.
Users are solely responsible for income taxes, GST obligations, sales taxes, VAT obligations, and employment taxes. Talent Tasker may request tax-related documentation where required.
8. Non-Circumvention
Clients and Talent introduced through Talent Tasker agree not to bypass the Platform to avoid service fees.
For twenty-four (24) months after first connecting through Talent Tasker:
- Clients shall not directly hire Talent outside the Platform.
- Talent shall not accept work outside the Platform from Clients introduced through the Platform.
Violation may result in account suspension, permanent termination, recovery of lost fees, or legal action.
9. Refunds
Platform fees, subscription fees, featured listing fees, advertising fees, and premium membership fees are non-refundable unless otherwise stated. Refund requests may be reviewed at Talent Tasker's sole discretion.
10. Reviews and Ratings
Users may leave reviews based on genuine experiences. Talent Tasker may remove reviews that are false, misleading, offensive, fraudulent, or spam. Attempts to manipulate ratings may result in account suspension.
11. Intellectual Property
Users retain ownership of content uploaded to the Platform. By uploading content, users grant Talent Tasker a worldwide, royalty-free, non-exclusive license to host, store, display, distribute, and promote such content for Platform operations.
All Talent Tasker trademarks, logos, software, branding, and platform content remain the exclusive property of Talent Tasker.
12. Confidentiality
Users may receive confidential information from other users. Users agree not to disclose confidential information, use confidential information for unauthorized purposes, or share private project details without consent. Confidentiality obligations survive termination of account access.
13. Prohibited Activities
Users shall not:
- Create fake accounts.
- Impersonate another individual or company.
- Engage in fraud.
- Post misleading information.
- Upload malware or harmful software.
- Violate intellectual property rights.
- Harass other users.
- Use automated scraping tools.
- Circumvent Platform fees.
- Conduct illegal activities.
14. Restricted Services
The following services are prohibited:
- Gambling services
- Adult content
- Escort services
- Illegal financial services
- Money laundering schemes
- Cryptocurrency scams
- Pyramid schemes
- Drug-related services
- Weapons-related services
- Hate speech
- Human trafficking
- Counterfeit products
- Any unlawful activity
Talent Tasker reserves the right to remove content and suspend accounts immediately.
15. Dispute Resolution Between Users
Talent Tasker may offer mediation assistance. However:
- Talent Tasker is not obligated to resolve disputes.
- Talent Tasker is not responsible for project outcomes.
- Users remain responsible for resolving contractual disagreements.
Talent Tasker may review evidence and issue non-binding recommendations.
16. Privacy
Use of the Platform is governed by the Talent Tasker Privacy Policy.
By using the Platform, users consent to the collection, storage, and processing of personal information in accordance with applicable laws.
17. Data Protection
Users agree that Talent Tasker may:
- Store account information.
- Process personal data.
- Use cookies and analytics technologies.
- Share information where legally required.
Users may request access, correction, or deletion of personal information as permitted by law.
18. Suspension and Termination
Talent Tasker may suspend or terminate accounts for violation of these Terms, fraudulent activity, illegal conduct, abuse of the Platform, or non-payment of fees.
Upon termination, access may be revoked immediately, data may be deleted, and outstanding obligations survive termination.
19. Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Talent Tasker does not warrant continuous availability, error-free operation, successful hiring, project completion, or business success.
All warranties, whether express or implied, are disclaimed to the fullest extent permitted by law.
20. Limitation of Liability
To the maximum extent permitted by law, Talent Tasker shall not be liable for indirect damages, lost profits, lost revenue, lost business opportunities, data loss, user disputes, or service interruptions.
Talent Tasker's total liability shall not exceed the amount paid by the user to Talent Tasker during the twelve (12) months preceding the claim.
21. Indemnification
Users agree to defend, indemnify, and hold harmless Talent Tasker, its directors, officers, employees, affiliates, and partners from claims arising out of violation of these Terms, user content, intellectual property infringement, user disputes, or violations of applicable law.
22. Third-Party Services
The Platform may contain links to third-party websites and services. Talent Tasker does not control and is not responsible for third-party websites, software, external payment providers, or content. Use of third-party services is at your own risk.
23. Force Majeure
Talent Tasker shall not be liable for delays or failures caused by natural disasters, internet outages, cyber attacks, government actions, labor disputes, war, pandemic events, or events beyond reasonable control.
24. Governing Law
Indian Users:
These Terms shall be governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh, India.
U.S. and International Users:
These Terms shall be governed by the laws of the State of Montana, United States. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Montana, United States.
25. Changes to Terms
Talent Tasker may modify these Terms at any time. Updated Terms become effective immediately upon publication on the Platform. Continued use of the Platform constitutes acceptance of the revised Terms.
